Tax Assessment Dispute Following Business Cessation
Sintesi Legislator
Generato dall'IAFollowing the cessation of construction business activity, a final tax assessment was issued with an initial taxable income of CHF 207,700, which was later reduced to CHF 90,300 after an appeal. The taxpayer then contested this revised assessment, leading the court to request an expert accounting report; after review by the court's own expert who confirmed accounting errors, a further reduction of the taxable income to CHF 57,750 was proposed by agreement between the experts and the parties. The appellate court accepted this proposal, finding the reduction to be based on substantial and largely unchallengeable accounting findings, thereby granting the appeal and reforming the prior decisions.
