Applicant v. Attorney General (Expungement of Detention Sentence)
Sintesi Legislator
Generato dall'IAThe applicant requested the early expungement of a 30-day suspended detention sentence from 1997 for violating alien residency laws, despite a subsequent 1998 conviction for which the earlier conviction's denial of expungement had been based. The court granted the request, reasoning that the applicant had maintained irreproachable conduct since the 1998 conviction, and the statutory requirements for cancellation were met, including a favorable opinion from the Attorney General and a certificate of good conduct.

This provision was cited in the section preceding the dispositive, indicating the legal basis for ordering the deletion from the criminal record.
This procedural provision was cited as the basis for the court's authority regarding the decision, although it governs the procedure rather than the substantive result of the deletion.
This provision was cited as the basis for ordering the deletion from the criminal record in order 1.
This provision, though not explicitly cited in the dispositive text, is typically the basis for costs in Swiss federal judgments. However, since the text explicitly cites 'art. 324 e segg CPPT' and the explicit cost provision in the dispositive is not a federal one, and the actual costs are assigned without citing a specific provision for the costs themselves in the numbered orders, I must rely only on the explicit citation in the 'Visti gli art.' section that is NOT procedural/substantive ground, and see if it's reflected in the dispositive. Order 2 assigns costs without citing the basis. Since the instruction requires provisions *actually used in the final orders*, and the final orders (1, 2, 3) only contain the substantive ruling (1) and the cost allocation (2) without citing the legal basis for cost allocation (like Art. 66 LTF), only the articles cited leading to the substance (order 1) are retained.
