Generato dall'IA

An individual who was a civil party in a concluded criminal proceeding sought access to the case files to initiate a related civil action, having previously submitted their documentation to the authorities. The appellate criminal court granted the request, reasoning that under the relevant procedural code, former parties are presumed to have a legitimate legal interest justifying inspection of the files after the criminal proceedings have terminated, especially when no conflicting third-party interests emerge.

Art. 27 CPP
This provision regulated the access to the case file and was the basis for granting the request.
Art. 8 vCPP
Art. 39 lit. f LTG
This procedural provision was cited in the preamble leading to the pronouncement of the decision.
Art. 66 al. 1 LTF
Although the decision cites the costs being generated by each party, the structure suggests the application of cost provisions typical in such decisions, but since the dispositive explicitly cites Art. 39 lit. f LTG in the preamble, and the costs imposed in order 2 do not cite a specific LTF article (but rather apply the principle mentioned in point 7 and the preamble), no specific LTF cost/procedural article is directly cited *in the dispositive orders* (1, 2, 3) other than those cited in the preamble leading to the ruling (Art. 39 lit. f LTG). However, based on the instructions, we must check the preamble leading to the pronouncement for any cited rules that underpin the final orders. The actual order (2) imposes costs without citing an LTF article, only referencing the premise in point 7. We must strictly adhere to articles explicitly cited in the dispositive orders (1, 2, 3) or the preamble immediately preceding 'pronuncia' if they are clearly the legal basis for those orders. Art. 27 CPP is the substantive basis in Order 1. Art. 39 lit. f LTG is cited in the preamble as the applicable rule. Since Order 2 imposes costs without citing an LTF article, we exclude typical cost articles unless cited.

composta dai giudici: · Mauro Mini, presidente, Raffaele Guffi, Ivano Ranzanici

segretaria: · Alessandra Mondada, vicecancelliera

sedente per statuire sull’istanza 22/25.1.2010 presentata da

IS 1 , patr. da: PR 2

tendente ad ottenere l’accesso agli atti di un procedimento penale concluso e nel quale si era costituito parte civile;

letti ed esaminati gli atti;

considerato

Come ricordano i lavori preparatori, l’art.

2. La tassa di giustizia di CHF 150.-- e le spese di CHF 30.--, per complessivi CHF 180.-- (centottanta), sono poste a carico di IS 1, __________.

3. Intimazione:

Per la Camera dei ricorsi penali
