Prosecutor v. Court on Premature Criminal File Transfer for Civil Action
Sintesi Legislator
Generato dall'IAThe appellate court reviewed a request to transfer a criminal case file for use in a pending ordinary civil action, where the lower court had already granted the transfer. The public prosecutor argued that accessing the file was premature before the conclusion of the investigation and formal filing of charges. The appellate court sided with the prosecutor, reasoning that the public interest in concluding the ongoing criminal investigation temporarily outweighed the interest in accessing the file, especially since access would be permitted once the case documents were formally filed, making the requested transfer premature.
