Prosecutor's Decision to Dismiss Fraud Case Upheld on Grounds of Inadmissible Appeal and Lack of Evidence
Sintesi Legislator
Generato dall'IAAn appeal against a public prosecutor's decision to dismiss criminal proceedings for fraud was deemed inadmissible because the filing party, the adult appellant's mother, lacked legal standing to represent her hospitalized son, as parents cannot substitute for adult children in exercising procedural rights without a formal appointment of a legal representative; furthermore, the appeal was deficient in form, and the court determined that, even on the merits, the original decision to drop the case was justified due to the absence of sufficient written evidence or indicators of a criminal offense, suggesting a matter primarily of civil law.

Incarto n. 60.2004.325 · Lugano 18 ottobre 2004 · In nome della Repubblica e Cantone del Ticino La Camera dei ricorsi penali del Tribunale d'appello
composta dai giudici: · Mauro Mini, presidente, Raffaele Guffi, Ivano Ranzanici
segretaria: · Daniela Rüegg, vicecancelliera
sedente per statuire sull’istanza di promozione dell’accusa 8.9.2004 presentata da
IS 1 , rappresentato dalla madre PA 1, , in relazione
al decreto di non luogo a procedere 7.9.2004 emanato dal procuratore pubblico __________ nell’ambito del procedimento penale dipendente dalla querela 29.6.2004 nei confronti di __________ PI 1, __________, per titolo di truffa;
considerato
in fatto ed in diritto
che il manoscritto 8.9.2004 è stato presentato dalla madre dell’istante, in rappresentanza del figlio;
che con lettera 10.9.2004 questa Camera chiedeva alla madre dell’istante se agisse quale rappresentante legale del figlio o in altra veste;
che con manoscritto ricevuto da questa Camera il 21.9.2004, la madre informava che il figlio è ricoverato in un ospedale fuori cantone;
C. VERDA, Commento del Codice di Procedura Penale ticinese, Lugano 1997, n. 5 ad art. 69 CPP; Rep. 1989, p. 598), e che pertanto l’istanza dovrebbe essere dichiarata irricevibile;
che l’istanza manoscritta non ossequia le esigenze poste dalla giurisprudenza di questa Camera in tema di istanza di promozione dell’accusa, e quindi dovrebbe essere dichiarata irricevibile anche per questo motivo;
che anche nel merito, il decreto di non luogo a procedere dev’essere confermato, ritenuto l’assenza di documenti scritti o di altre prove o indizi sufficienti per ritenere che ci siano elementi di un’infrazione penale, in una fattispecie di connotazione tipicamente civile;
che data la particolarità del caso, si prescinde dal prelievo di tassa di giustizia e di spese;
Per questi motivi,
richiamati gli art. 184 ss. CPP, 146 CP, 1 ss. e 39 lit. f LTG ed ogni altra norma applicabile,
pronuncia
1. L’istanza è irricevibile.
2. Non si prelevano tassa di giustizia e spese.
