A party to an administrative appeal, which sought reimbursement from another party for damages related to the closure of a municipal water network, subsequently withdrew its petition, leading the court to conclude the proceedings were exhausted. Given that the opposing party was represented by counsel, the court deemed an award for legal costs justified, ultimately dismissing the appeal from the record without levying taxes or expenses, but ordering the appellant municipality to reimburse the respondent a specific amount for costs.

Art. 265 c.p.c.

Although not explicitly stated as the basis for the ruling on costs, the reference to the reimbursement of 'ripetibili' (costs) implies the application of relevant procedural rules for concluding the case, which, in this context (cantonal administrative court, decision from 2004), often relates to the Code of Civil Procedure concerning administrative proceedings.
