A municipality filed an administrative appeal against a state council decision that declared inadmissible its challenge to another municipality's decision authorizing a resident to attend a primary school outside their commune, based on an inter-communal agreement. The administrative court rejected the appeal, reasoning that while the challenging municipality's appeal was timely, the *municipality* (the territorial public corporation) has legal capacity and standing to sue, not its executive body, the *municipality*, which merely represents the former in court, thereby upholding the lower authority's finding of inadmissibility due to the appellant's lack of active standing.

Incarto n. 52.2007.247 · Lugano 26 luglio 2007 · In nome della Repubblica e Cantone Ticino Il Presidente del Tribunale cantonale amministrativo Lorenzo Anastasi

assistito dal segretario: · Massimiliano Cometta, vicecancelliere

statuendo sul ricorso 24 luglio 2007 del

RI 1 Contro

la decisione 11 luglio 2007 (n. 3752) del Consiglio di Stato che dichiara irricevibile l'impugnativa presentata dal municipio di RI 1 contro la decisione 8 giugno 2007 del municipio di __________ in materia scolastica;

letti ed esaminati gli atti;

richiamati gli art. 48 PAmm e

49 cpv. 2 LOG;

ritenuto, in fatto

che dopo vicissitudini che non occorre qui rievocare, l'8 giugno 2007 il municipio di __________ ha autorizzato __________, residente a __________, a frequentare il primo anno di scuola elementare presso il __________;

che contro il predetto giudizio, il 14 giugno 2007 il municipio di RI 1 è insorto davanti al Consiglio di Stato lamentando la violazione da parte del comune __________ di una convenzione vigente tra i due comuni che garantisce agli allievi di __________ la frequenza delle scuole elementari di __________;

che con giudizio 11 luglio 2007 il Governo ha dichiarato irricevibile il gravame per mancanza di legittimazione attiva del municipio insorgente, stante che legittimato a ricorrere è unicamente il comune;

che contro il predetto giudicato governativo il RI 1 si aggrava ora davanti al Tribunale cantonale amministrativo, chiedendone implicitamente l'annullamento sulla scorta di argomenti che non è necessario riassumere;

considerato, in

diritto

che, giusta l'art. 48 PAmm, l'autorità di ricorso, immediatamente o dopo richiamo degli atti, può decidere di respingere il ricorso con breve motivazione, se lo stesso si riveli inammissibile o manifestamente infondato;

che la competenza del Tribunale cantonale amministrativo è data dall'art. 208 cpv. 1 LOC; l'art. 21 LE richiamtato dal Consiglio di Stato non c'entra assolutamente;

che la legittimazione attiva del comune ad impugnare la risoluzione governativa è certa (art. 43 PAmm);

che il ricorso, tempestivo (art. 46 cpv. 1 PAmm), è pertanto ricevibile in ordine;

che il giudizio può essere reso sulla base degli atti, senza istruttoria (art. 18 cpv. 1 PAmm);

che per costante giurisprudenza di questo tribunale, al municipio va negata la legittimazione a ricorrere;

che in effetti, il municipio è soltanto l'organo esecutivo del comune (art. 17 cpv. 3 Cost. TI; 9 lett. c, 80 e 106 LOC); non si identifica con esso, ma lo rappresenta soltanto davanti all'autorità giudiziaria; legittimato a ricorrere e detentore della qualità per agire in giudizio è soltanto il comune; il municipio non ha invece né capacità giuridica, né capacità di essere parte (cfr. STF 5.3.1999 in re municipio di I., in RDAT-II 1999, n. 48);

che sulla scorta della succitata giurisprudenza federale, nonostante il municipio possa introdurre un ricorso in nome del comune, del quale è organo, solo quest'ultimo in quanto corporazione di diritto pubblico a base territoriale ha capacità giuridica e capacità di essere parte (cfr. tra le tante: STA 23.04.2007, n. 52.2007.130, in re municipio di S.);

che, stante quanto precede, è quindi a giusta ragione che il Governo ha dichiarato irricevibile il ricorso presentato dal RI

1 a proprio nome e conto;

che in questa sede il ricorso deve pertanto essere respinto, senza entrare nel merito delle censure sollevate dall'insorgente;

che si prescinde dal prelievo di una tassa di giustizia (art. 28 PAmm).

Per questi motivi,

visti gli art. 9, 80, 106, 208 LOC; 49 cpv. 2 LOG; 3, 18, 28, 43, 46, 48, 60 e 61 PAmm;

dichiara e pronuncia:

1. Il ricorso è respinto.

113 ss LTF).
