Construction Company Appeal of Direct Award Following Consortium Insolvency
Sintesi Legislator
Generato dall'IAA construction company appealed a municipal decision that awarded traffic management works directly to a different company following a public tender where the appellant, as part of a consortium, had initially been awarded the contract. The municipality's subsequent direct award was prompted by one consortium member declaring insolvency and the inability of the consortium to proceed, leading to the works being urgently re-awarded to the remaining viable partner. The administrative court found the appeal admissible but ultimately ruled that since the appellant only sought confirmation of the initial award decision (which had never been formally revoked), that prior decision remained valid for the consortium, and any dispute regarding the necessity of the subsequent direct award or the formal contract should be addressed in civil court.

Generato dall'IAThis provision is listed in the final decree section (even though not explicitly used in order 1 or 2), suggesting it was relevant to the resolution contextually, but since the instruction demands only those explicitly cited in the numbered orders, and order 1 only refers to 'ai considerandi', we must check which provisions were cited in the dispositive structure. Upon reviewing the list of articles cited before the dispositive, Art. 37 LCPubb is listed, but since the actual numbered orders (1 and 2) do not cite it, it must be excluded based on the strict rule.
This provision is listed before the dispositive orders but is not explicitly cited in orders 1 or 2. Since order 1 states the appeal is decided as per the considerations, and these considerations did not result in a specific procedural ruling that cites Art. 31 PAmm in the final orders, it is excluded.

segretario: · Leopoldo Crivelli
statuendo sul ricorso 25 aprile 2003 della
__________ contro
la decisione 31 marzo 2003 del municipio di __________, che delibera alla ditta __________ i lavori di sistemazione e moderazione del traffico di via __________ /via __________;
viste le risposte:
- 14 maggio 2003 del municipio di __________;
- 14 maggio 2003 dell'impresa di costruzioni __________;
letti ed esaminati gli atti;
ritenuto, in fatto
che il 4 luglio 2002 il municipio di __________ ha indetto un pubblico concorso, retto dalla LCPubb (procedura libera) per l'aggiudicazione delle opere da impresario costruttore relative alla sistemazione di via __________ /via __________;
che l'inizio dei lavori era previsto per il 7 ottobre 2002 (cfr. capitolato d'appalto, pos. 121.200);
con decisione 29 novembre 2002 il municipio ha deliberato i lavori al consorzio formato dalle imprese di costruzione __________ e __________ per l'importo di fr. 1'983'548.95; l'inizio dei lavori è stato posticipato alla primavera di quest'anno;
che contrariamente a quanto prevede l'art. 35 LCPubb la delibera non si è tradotta nella sottoscrizione di un contratto d'appalto tra il comune ed il consorzio aggiudicatario;
che il 3 febbraio 2003 la Pretura di Lugano ha concesso alla __________ una moratoria concordataria (FU n. __________);
che il 26 marzo 2003 il municipio ha chiesto al consorzio aggiudicatario di iniziare i lavori il 7 aprile seguente;
che la __________, non essendo in grado di dar seguito agli impegni assunti, ha offerto alla __________ di rilevare la sua quota di partecipazione (50%);
che, declinata l'offerta, il 7 aprile 2003 la __________ ha iniziato i lavori da sola;
che con decisione 31 marzo 2003, notificata alla __________ il 10 aprile seguente, il municipio ha deliberato i lavori alla sola __________;
che contro questa decisione la __________ è insorta davanti al Tribunale cantonale amministrativo, chiedendo di confermare la delibera del 29 novembre 2002;
che il ricorso è avversato dal municipio e dalla __________, che ne chiedono il rigetto con argomenti di cui si dirà semmai qui appresso;
considerato, in
diritto
che la competenza del Tribunale cantonale amministrativo è data dall'art. 36 cpv. 1 LCPubb;
che la legittimazione attiva dell'insorgente, personalmente e direttamente toccata dal provvedimento impugnato, è certa;
che il ricorso, tempestivo, è dunque ricevibile in ordine;
che il giudizio può essere reso sulla base degli atti, senza istruttoria (art. 18 PAmm);
che giusta l'art. 12 cpv. 1 LCPubb, il committente può aggiudicare eccezionalmente una commessa direttamente ad un offerente senza bando di gara;
che l'aggiudicazione per incarico diretto è ammessa in particolare quando a causa di eventi imprevedibili la commessa è divenuta a tal punto urgente che non può essere esperita un’altra procedura (art. 13 cpv. 1 lett. d);
che con la decisione 31 marzo 2003, qui impugnata, il municipio ha deliberato i lavori per incarico diretto alla __________; la precedente delibera non è stata formalmente revocata;
che la ricorrente non chiede l'annullamento della nuova delibera; non occorre dunque verificare se la sopraggiunta impossibilità della __________ di far fronte agli impegni assunti costituisca un evento imprevedibile che ha reso la commessa a tal punto urgente da escludere l'esperimento di un'altra procedura;
che l'insorgente sollecita unicamente la conferma della precedente decisione di aggiudicazione;
che la decisione 29 novembre 2002 con cui il municipio ha deliberato i lavori al consorzio __________ /__________ non è mai tuttavia stata revocata;
che alla ricorrente va quindi dato atto che la delibera in questione continua a sussistere;
che, ferme queste premesse, il ricorso può essere evaso ai sensi dei considerandi;
che eventuali contestazioni riguardanti il contratto d'appalto, che avrebbe dovuto essere stipulato tra il comune ed il consorzio __________ /__________ a seguito della delibera del 29 novembre 2002, vanno proposte davanti al giudice civile;
che, dato l'esito, si prescinde dal prelievo di una tassa di giustizia e dall'assegnazione di ripetibili;
per questi motivi,
visti gli art. 12, 13, 36, 37 LCPubb; 3, 18, 28, 31, 60, 61 PAmm;
dichiara e pronuncia:
1. Il ricorso è evaso come ai considerandi.
2. Non si preleva tassa di giustizia; non si assegnano ripetibili.
3. Intimazione a: · __________
