Executive Order Enforcement and Acquiescence in Pension Contribution Dispute
Sintesi Legislator
Generato dall'IAA petitioner sought the enforcement of an executive order for the payment of CHF 15,954.35 plus interest related to professional pension contributions for the years 1999 and 2000. The respondent foundation subsequently declared its unconditional adherence to the petitioner's claim, which the court recognized as an act of acquiescence that terminated the dispute with material res judicata effect. Consequently, the court struck the petition from the roll due to this acquiescence, definitively rejected the opposition to the executive payment order for the claimed amount, and ruled that no court fees or indemnities for legal representation would be awarded, even to the successful petitioner.
