Correction of Clerical Error in Withdrawal Decree Regarding Disability Insurance Appeal
Sintesi Legislator
Generato dall'IAThe court addressed a request to rectify a clerical error in the withdrawal decree dated August 28, 2001, concerning an appeal against the disability insurance office's decision. The original decree mistakenly stated that the opposing party proposed the rejection of the appeal, but the court found that the opposing party's response of August 20, 2001, actually proposed recognizing a 50% work incapacity starting January 1, 1999, leading to a half disability pension from January 1, 2000. Therefore, exercising its authority under procedural law, the court decreed the correction of the text in the withdrawal decree to accurately reflect the opposing party's proposal, while leaving the rest of the decree unchanged and issuing no fees or costs.
