Smoke Emission Fine Appeal After Engine Repair
Sintesi Legislator
Generato dall'IAThe appellant was fined for operating a motorcycle that produced excessive smoke and odor, a violation of traffic regulations prohibiting avoidable nuisances. The appellant appealed, asserting that the issue resulted from burning residual oil immediately after receiving engine work at a garage, a claim supported by a recent repair invoice and confirmed by the smoke dissipating shortly thereafter. The court reasoned that since the objective offense (excessive smoke) was not disputed, the lack of a culpable subjective element, given the temporary nature of the fault following mechanical service, necessitated the acquittal of the appellant and the annulment of the initial decision.

ritenuto in fatto
*"Alla guida del motoveicolo TI __________ produceva fumo e puzzo eccessivi”;* che la risoluzione è stata resa in applicazione degli art. 42 cpv. 1 e 90 cifra 1 LCStr; 34 cpv. 1 ONC;
che contro predetta pronuncia dipartimentale RI 1 si aggrava ora davanti a questo giudice chiedendone in sostanza l’annullamento;
considerato in diritto
che il ricorso, tempestivo, è ricevibile in ordine giusta l'art. 4 LPContr e può essere giudicato sulla base degli atti a norma dell'art. 12 LPContr;
che per l’art. 42 cpv. 1 LCStr il conducente deve astenersi dal cagionare agli utenti della strada e ai vicini qualsiasi molestia evitabile, in particolare con rumore, polvere, fumo o puzzo e deve evitare, il più possibile, di spaventare gli animali (cfr. inoltre l’art. 34 cpv. 1 ONC);
che chiunque contravviene alle norme della circolazione contenute nella LCStr o nelle prescrizioni di esecuzione del Consiglio federale è punito con la multa (art. 90 cifra 1 LCStr);
che la CRTE 1 rimprovera al multato – in applicazione delle predette disposizioni – di aver alla guida del motoveicolo __________ prodotto fumo e puzzo eccessivi (con riferimento al rapporto di contravvenzione 7 luglio 2008 steso da un agente della Polizia __________, dal quale si evince che il fumo e il puzzo erano dovuti al cattivo funzionamento del motore);
*“La moto è stata ritirata alcuni minuti prima dal garage __________ in via __________. Subito dopo un poliziotto mi ha fermato facendomi notare che dalla moto fuoriusciva fumo nero. Ho detto subito che alla moto è stato cambiato il motore e probabilmente stava bruciando dell’olio. Giunto a casa non usciva più nessun fumo (…)”;*
che a sostegno del suo assunto, l’insorgente produce la fattura 1° luglio 2008 del garage __________ Sagl (sito in via__________, a __________, luogo in cui è stata accertata la presunta infrazione), dalla quale risulta l’intervento indicato;
che in concreto nulla induce a dubitare della bontà delle giustificazioni addotte dal ricorrente (confermate dalla fattura del garage); tant’è che la stessa CRTE 1, preso atto delle doglianze ricorsuali, si è rimessa al giudizio della Pretura penale;
che in conclusione, difettando l’aspetto soggettivo dell’infrazione, il ricorrente va prosciolto dall’addebito mossogli e la decisione impugnata annullata;
15 LPContr).
per questi motivi visti gli art. 42 cpv. 1 e 90 cifra 1 LCStr; 34 cpv. 1 ONC; 1 segg. LPContr;
dichiara e
pronuncia: 1.
2. Non si prelevano né tasse né spese.
