Traffic Fine Collection Custody Appeal and Prescription Ruling
Sintesi Legislator
Generato dall'IAAn individual appealed decisions from the collection office converting multiple unpaid traffic fines into custodial sentences (arrest), arguing inability to pay due to financial constraints and the necessity to work to support family. The court determined that the basis for the appeal regarding the inability to avoid custody was unfounded because the impending arrest would be served under a semi-liberty regime, which would not interfere with employment; however, the court partially granted the appeal because two of the underlying fines had become time-barred due to the lapse of the three-year prescription period under the relevant penal code articles, while confirming the conversion decisions for the remaining, non-prescribed fines.
