An individual appealed a fine and associated justice fees imposed by the immigration authority for employing a foreign domestic worker without the necessary work permit between 1998 and 2001, arguing for leniency due to good faith, advanced age, and the limited weekly hours worked. The court dismissed the appeal, reasoning that an employer has a strict duty to verify a foreign worker's authorization, and neither good faith nor the sporadic nature of the employment qualified the violation as a case of minimal gravity warranting exemption or further reduction, especially since the initial fine already reflected a substantial reduction.

Art. 4 LPContr
Art. 12 LPContr
This article was mentioned in the reasoning section to justify proceeding based on the file, but it is NOT explicitly cited in the final dispositive orders (1, 2, 3, 4) or in the consolidated list immediately preceding them.
Art. 10 cpv. 1 OLS
Cited in the grounds for decision and included among the articles considered before Order 1, as it deals with the employer's duty regarding verifying permits, forming part of the justification for rejecting the appeal.
Art. 15 LPContr
Cited in the concluding paragraph before the orders as the basis for ordering costs following the dismissal of the appeal.
Art. 273 PP
Cited in Order 3, which sets the deadline and procedure for filing a further appeal with the Federal Supreme Court.
Art. 272 PP
Cited in Order 3, which sets the deadline for filing a further appeal with the Federal Supreme Court.
art. 29 cpv. 1 OLS
Cited in the grounds for decision, though not explicitly mentioned in the dispositive orders 1 or 2, the inclusion rule states to only include provisions cited in the dispositive orders. However, based on the reasoning section, the court relied on several articles to reject the appeal, and the final list of cited articles before the operative part includes this one. Since the instruction demands citation *in* the dispositive orders (1, 2, 3, 4), and this one is not in 1, 2, or 3, I must check the context. The dispositive part lists the articles considered: 'visti gli art. 3 cpv. 3, 23 cpv. 6 LDDS, 3 cpv. 6 ODDS, 6, 10 cpv. 1 e 29 cpv. 1 OLS, 1 segg. LPContr;'. Order 1 confirms the decision based on these articles. Thus, it is included as part of the ground for rejection.
art. 23 cpv. 6 LDDS
Cited as one of the articles considered ('visti gli art...') before rendering Order 1, forming part of the legal basis for confirming the original decision.

Il Giudice della Pretura penale Marco Ambrosini

sedente con la segretaria Carmela Fiorini per statuire sul ricorso del 13 maggio 2002 presentato da

_______ _______, _______ (patrocinato dall'avv. _______ _______, _______) contro la decisione n. _______ /_______ del _______ 2002 emessa dalla Sezione dei permessi e dell'immigrazione, _______, viste le osservazioni del 27 maggio 2002 presentate dalla Sezione dei permessi e dell'immigrazione;

letti ed esaminati gli atti;

ritenuto in fatto:

che la Sezione dei permessi e dell'immigrazione, con decisione del 26 aprile 2002, ha inflitto a _______ _______ una multa di fr. 600.–, addebitandogli inoltre una tassa di giustizia di fr. 200.–, per avere egli "impiegato in qualità di collaboratrice domestica, dal 1.7.1998 al 13.9.2001, con una frequenza settimanale di 3 ore, la cittadina straniera _______ _______ _______, 1957, sprovvista del permesso … che le consentisse di svolgere detta attività" (decisione citata, con rinvio al rapporto di contravvenzione dell'11 marzo 2002);

che contro tale risoluzione _______ _______ è insorto con un ricorso del 13 maggio 2002 in cui chiede di prescindere dalla multa o, se non altro, di ridurne l'entità;

che la Sezione dei permessi e dell'immigrazione, nelle sue osservazioni del 27 maggio 2002, propone il rigetto del gravame e la conferma della decisione impugnata;

e considerato in diritto:

che la competenza di questo giudice, la legittimazione attiva dell'insorgente e la tempestività dell'impugnativa sono date dall'art. 4 LPContr, ragion per cui il ricorso è ricevibile in ordine e può essere giudicato sulla base degli atti a norma dell'art. 12 LPContr;

che l'autorità di primo grado ha sanzionato l'interessato, come detto, per avere impiegato una collaboratrice domestica straniera sprovvista di regolare autorizzazione;

che l'insorgente non nega di aver commesso l'infrazione rimproveratagli, ma fa valere di aver agito in buona fede, di essere ormai in età avanzata e di avere occupato la lavoratrice solo per poche ore di lavoro settimanali, circostanze che – a suo dire – giustificano l'esenzione da ogni pena o, quanto meno, una riduzione della multa;

che l'eventuale buona fede dell'interessato non consente tuttavia di discostarsi dalla decisione impugnata, ove solo si consideri come il datore di lavoro non deve impiegare uno straniero senza essersi preventivamente assicurato, consultando il libretto per stranieri oppure informandosi presso l'autorità di polizia degli stranieri, che il lavoratore è autorizzato ad assumere l'occupazione (art. 10 cpv. 1 OLS);

che neppure la saltuarietà dell'impiego, né tanto meno l'età avanzata del ricorrente bastano – da sé soli

– a connotare la fattispecie come un "caso di minima gravità" nel senso dell'art. 23 cpv. 6 seconda frase LDDS;

che, del resto, la Sezione dei permessi e dell'immigrazione ha già tenuto conto delle particolarità del caso concreto, concedendo all'interessato "una consistente riduzione sull'importo" della multa (decisione impugnata, nel mezzo; cfr. anche osservazioni del 27 maggio 2002, pag. 1 in basso e pag. 2 in alto);

che la sanzione inflitta, in definitiva, è proporzionata alla gravità dell'infrazione commessa, rettamente commisurata al grado di colpa e contenuta nei limiti concessi dalla legge, sicché il ricorso dev'essere respinto, seguito da tassa di giustizia e spese (art. 15 LPContr);

per questi motivi, visti gli art. 3 cpv. 3, 23 cpv. 6 LDDS, 3 cpv. 6 ODDS, 6, 10 cpv. 1 e 29 cpv. 1 OLS, 1 segg. LPContr;

pronuncia: 1.

272 PP).

4. Intimazione a:

– _______ _______, _______, – avv. _______ _______, _______, – Sezione dei permessi e dell'immigrazione, _______.
