Civil Parties' Appeal of Manslaughter Acquittal Barred by Prescription Period
Sintesi Legislator
Generato dall'IAThe appellants, as civil parties, appealed a lower court's acquittal of the appellees of charges related to involuntary manslaughter and violation of construction standards following a fatal workplace accident in 1992. The Court of Cassation and Revision found that although the appeal was timely filed following the April 10, 2000, acquittal decision, the absolute prescription period for the criminal actions, which began on November 14, 1992, expired on May 14, 2000, prior to the submission of the detailed grounds for appeal, leading the court to declare the appeal inadmissible as the lapse of prescription, which is ascertainable ex officio, precludes examination of the merits.

__________, (patrocinato dall'avv. __________) e di __________ (patrocinato dall'avv. __________)
esaminati gli atti,
posti i seguenti
punti di questione: 1. Se deve essere accolto il ricorso per cassazione;
2. Il giudizio sulle spese.
Ritenuto
in fatto: che con sentenza del 10 aprile 200 il presidente della Corte delle assise correzionali di __________ ha prosciolto __________ e __________ dalle imputazioni di omicidio colposo e di violazione delle regole dell'arte edile contenute in un decreto di accusa emanato il 24 gennaio 2000 dal Procuratore pubblico in seguito a un infortunio avvenuto il 14 novembre 1992 su un cantiere a __________, ove aveva perduto la vita __________, dipendente della ditta __________;
che contro la sentenza di assise __________ e __________, genitori della vittima costituitisi parte civile nel procedimento penale, hanno inoltrato il 14 aprile 2000 una dichiarazione di ricorso alla Corte di cassazione e di revisione penale;
che nei motivi del gravame, presentati il 23) maggio successivo, essi postulano l'annullamento della sentenza di assise per arbitrio, in subordine l'annullamento del dispositivo di assoluzione
n.
1.1 per vizi di procedura, ancorché nel frattempo sia intervenuta la prescrizione assoluta delle azioni penali (attribuibile, secondo i ricorrenti, all'ingiustificata lentezza della procedura);
che non sono state chieste osservazioni sul ricorso;
e considerando
in diritto: che l'azione penale per i reati di omicidio colposo (art. 117 CP) e di violazione delle regole dell'arte edile (art. 229 cpv. 2 CP), punibili entrambi con la detenzione o con la multa, soggiace al termine di prescrizione relativa di 5 anni e a quello di prescrizione assoluta di 7 anni e sei mesi (art. 70 e 72 CP);
che nella fattispecie la prescrizione delle singole azioni penali è cominciata a decorrere il 14 novembre 1992 (giorno dell'infortunio);
che allorché la decisione di assise è stata emanata, dopo un complesso iter procedurale durato anni, il 10 aprile 2000, la prescrizione (assoluta) dell'azione penale non si era ancora compiuta;
che la prescrizione assoluta non era ancora intervenuta nemmeno il 14 aprile 2000, quando la parte civile ha dichiarato (nel termine stabilito dall'art. 289 cpv.
1 CPP) di ricorrere alla Corte di cassazione e di revisione penale contro la sentenza di assise, impedendone in tal modo il passaggio in giudicato, né era intervenuta quando alle parti è stata intimata la sentenza motivata, il 2 maggio 2000;
che la prescrizione assoluta si è compiuta invece poco dopo, il 14 maggio 2000, comunque prima che il termine di 20 giorni per presentare le motivazioni scritte del ricorso per cassazione venisse a scadere (art. 289 cpv. 2 CPP);
che benché tempestivo, il ricorso non può pertanto essere esaminato nel merito, l'intervenuta prescrizione dell'azione penale (accertabile d'ufficio, trattandosi di un presupposto processuale) comportandone l'inammissibilità (cfr. DTF 116 IV 80);
che, data la particolarità del caso, si prescinde eccezionalmente dal riscuotere spese e tassa di giustizia;
per questi motivi,
pronuncia: 1. Il ricorso è inammissibile.
2. Non si riscuotono tasse né spese.
3. Intimazione:
