Appeal Regarding Cost Allocation After Dismissal of Defective Product Claim
Sintesi Legislator
Generato dall'IAThe appeal challenged the allocation of legal costs from a lower court decision that dismissed a claim seeking a refund for a defective television. The appellant argued that since the main claim against them was rejected, they should not have been ordered to pay the costs according to the general rule of the losing party bearing the expense. The appellate court reasoned that although the lower court cited the wrong legal basis, its decision to allocate costs to the appellant was justified under the equity provision of the procedural code, as the initial fault related to the seller's inability to remedy a simple setting issue, which provided the claimant with a good-faith reason to litigate, leading the appellate court to dismiss the appeal and, exceptionally, waive the recovery of appeal costs due to the appellant's lack of legal representation.

RE 1
contro la sentenza 12 novembre 2015 del Giudice di pace del circolo delle Isole nella causa n. SE 11/2014 (compravendita) promossa con istanza 17 dicembre 2014 da
CO 1;
esaminati gli atti
ritenuto
in fatto: che con decisione del 12 novembre 2015 il Giudice di pace del circolo delle isole ha respinto un'istanza di CO 1 volta a ottenere da RE 1 il pagamento di fr. 1998.– “corrispondenti al prezzo da lui pagato per un televisore risultato difettoso”;
che contestualmente la tassa di giustizia di fr. 200.– e le spese peritali di fr. 440.– sono state poste a carico del convenuto, tenuto a rifondere all'istante un'indennità d'inconvenienza di fr. 100.–;
che contro il dispositivo sulle spese giudiziarie RE 1 è insorto a questa Camera chiedendo, previo conferimento dell'effetto sospensivo, di addebitarle alla controparte;
che non sono state chieste osservazioni al reclamo;
e considerando
in diritto: che, in concreto, il Giudice di pace ha addebitato le spese giudiziarie al convenuto, richiamando il principio dell'art. 106 cpv. 1 CPC;
che secondo tale norma, le spese giudiziarie sono poste a carico della parte soccombente;
che a ragione quindi il reclamante fa valere di non essere risultato soccombente, giacché l'istanza di CO
1 è stata respinta;
che, nondimeno, dalla sentenza impugnata risulta con ogni evidenza come l'indicazione della norma di legge si riconduca a un palese errore di scrittura;
che, in effetti, il primo giudice ha addebitato le spese giudiziarie al convenuto, poiché “non è stato in grado di aggiornare il televisore e non ne sarebbe stato direttamente capace visto il contenuto delle sua raccomandata ... e la sua mail...”;
che con tale argomentazione, non contestata dal reclamante, il Giudice di pace ha prescisso dai principi della soccombenza e ha ripartito le spese giudiziarie secondo equità come previsto dall'art. 107 cpv. 1 CPC;
che così decidendo il primo giudice non è incorso in un'errata applicazione del diritto ove si pensi che a fronte di un “difetto causato da un semplice problema di impostazione da cambiare senza spostamento del televisore”, l'istante vista la posizione del convenuto aveva in buona fede motivo di agire in giudizio;
che nelle circostanze descritte il reclamo deve essere respinto, ciò che rende senza oggetto la richiesta di effetto sospensivo;
che le spese processuali seguirebbero la soccombenza (art. 106 cpv, 1 CPC), ma le circostanze del caso specifico inducono a rinunciare – eccezionalmente – a ogni prelievo, il reclamante essendo sprovvisto di cognizioni giuridiche e avendo agito senza l'ausilio di un patrocinatore (art. 107 cpv. 1 lett. f CPC);
che non si pone problema di indennità all'istante, al quale il reclamo non è stato notificato per osservazioni.
Per questi motivi,
decide: 1. Il reclamo è respinto.
2. Non si prelevano spese processuali.
3. Notificazione a:
