A party sought payment of CHF 1,200 for auto body repair work, which the lower court granted based on uncontested documentation provided by the claimant, who had been hired by the defendant to perform the repairs on a third party's vehicle after the defendant caused damage. The appellate court rejected the defendant's cassation appeal challenging the judgment on the grounds that the claim was solely based on an unverified invoice, because the appellant's objections regarding proper notification and acceptance of the invoice were new arguments inadmissible at the cassation stage, as the underlying facts (the mandate, invoicing, and receipt of the invoice) remained uncontested from the lower proceedings.

Art. 321 cpv. 1 lett. b CPC
Cited in the reasoning to justify the rejection of the appeal due to new facts/evidence being introduced, although it justifies the overall outcome (rejection) it is not explicitly in the final dispositive orders 1, 2, or 3, so it is excluded based on strict rule interpretation. **Correction**: Since the decision ultimately rejects the appeal (Order 1), the procedural basis for the overall decision (rejection) should be sought in the dispositive. The article that establishes the ground for rejection *is* cited in the reasoning, but the dispositive only cites CPC articles related to the mechanism of the cassation appeal and costs.
Art. 331 cpv. 1 CPC
Cited in the reasoning regarding the applicability of art. 313 bis CPC to the cassation appeal procedure. This procedural reasoning supports the nature of the decision, but it is not explicitly cited in the dispositive orders 1, 2, or 3.
Art. 148 cpv. 1 CPC
Cited in Order 2 for imposing costs upon the appellant based on the principle that costs follow the event (soccombenza).
art. 313 bis CPC
Cited in the reasoning regarding the power to decide on rejection without notification when the appeal is inadmissible or manifestly unfounded. This procedural reasoning supports the nature of the decision, but it is not explicitly cited in the dispositive orders 1, 2, or 3.
art. 327 segg. CPC
Cited in the pre-dispositive section as the procedural basis for the cassation appeal, although not explicitly in orders 1, 2, or 3.

considerato

in fatto e in diritto: che con istanza 25 agosto 2004 la ditta individuale __________CO 1, titolare dell'omonimo garage a __________, ha convenuto in giudizio __________RI

1 per ottenere il pagamento di fr. 1'200.– a saldo della fattura emessa il 15 settembre 2003 per lavori di carrozzeria eseguiti per conto di quest'ultimo su un autovettura di una terza person__________che egli aveva danneggiato assumendosene la responsabilità;

che con sentenza 25 ottobre 2004 il Giudice di pace, ritenendo sufficientemente comprovato il credito dell’istante sulla base della documentazione prodotta, alla quale il convenuto non ha opposto nessuna contestazione non avendo presenziato all’udienza, ha accolto l’istanza condannando il convenuto al pagamento di fr. 1'200.– oltre interessi del 5% dal 25 febbraio 2004 e fr. 70.– a titolo di spese esecutive, importo per il quale ha pure rigettato in via definitiva l'opposizione interposta dal convenuto al PE n. __________ dell'UEF di Mendrisio;

che con il presente tempestivo gravame __________RI 1 è insorto contro il predetto giudizio postulandone l'annullamento;

che il ricorso, con il quale il ricorrente rimprovera in sostanza al Giudice di pace di aver accolto le pretese di parte istante unicamente sulla base della fattura da questa allestita senza verificare che questa gli sia stata effettivamente notificata e quindi accettata, è manifestamente infondato;

che infatti, a prescindere dal fatto che il convenuto, assente alla discussione dell'istanza, non ha contestato la documentazione e le allegazioni dell’istante, le sue odierne contestazioni non possono essere considerate, siccome proposte per la prima volta in questa sede ricorsuale, ciò che è inammissibile ai sensi dell'art. 321 cpv. 1 lett. b CPC secondo cui è vietata alle parti la facoltà di addurre in questa sede nuovi fatti, prove o eccezioni;

che, quindi, l’incarico impartito dal convenuto al garagista di eseguire i lavori, l’invio della fattura al convenuto e la ricezione della stessa da parte del medesimo sono rimasti inconstestati;

che pertanto la sentenza impugnata, frutto di una corretta valutazione delle risultanze istruttorie e altrettanto corretta applicazione del diritto sostanziale, non ha motivo per essere cassata, così che il ricorso dev'essere respinto;

che giusta l’art. 313 bis CPC, applicabile anche alla procedura di ricorso per cassazione in virtù del rinvio di cui all’art. 331 cpv. 1 CPC, questa Camera può decidere con breve motivazione la reiezione dello stesso senza notifica alla controparte per le osservazioni qualora questo si rilevi inammissibile o manifestamente infondato;

che le spese seguono la soccombenza (art. 148 cpv.
