Appeal Moot Due to Enforcement Withdrawal
Sintesi Legislator
Generato dall'IAA party appealed the actions of the Enforcement Office concerning the creditor's schedules filed in two foreclosure proceedings against properties owned by the debtor. The appellate court, acting as the supervisory authority, noted that the enforcement office subsequently reported that the enforcement procedures had been withdrawn, specifically that the mortgage creditor had renounced the sale for one property but not the other, resulting in the cancellation of the auction. Consequently, the court reasoned that the appeal proceedings had become moot, and therefore they were struck from the records pursuant to relevant procedural law, with no court fees or indemnities levied.
