Appellant Withdraws Appeal; Case Struck from Roll with Final Judgment Effect
Sintesi Legislator
Generato dall'IAThe appellant, challenging a lower court decision that partially upheld an execution order against them, subsequently withdrew their appeal, which the appellate court treated as a voluntary cessation of litigation, resulting in the case being struck from the roll with a ruling that has the effect of a final judgment. The court reasoned that because the withdrawal amounted to a voluntary cessation of the case, the appellant was deemed the losing party and thus responsible for the related procedural costs, noting that because the matter was resolved solely by accepting the withdrawal and did not require service upon the opposing party, no award for reimbursement of legal fees was warranted, and the threshold for further federal appeal was not met.

RE 1
giudicando sul reclamo del 13 gennaio 2022 presentato da RE 1 contro la decisione emessa il 3 gennaio 2022 dal Giudice di pace supplente, con cui ha parzialmente accolto di CO 1 e di conseguenza ha rigettato in via definitiva l’opposizione all’esecuzione n. __________ promossa contro il reclamante limitatamente a fr. 1'350.– e l’ha condannato a rimborsare all’istante fr. 900.– entro 30 giorni dalla ricezione della decisione, ponendo a suo carico le spese processuali di fr. 150.–;
preso atto dello scritto del 1° febbraio 2022 con cui RE 1 ha dichiarato di ritirare il reclamo;
cpv. 1 e 2 CPC, per il rinvio dell’art. 219 CPC; Tappy in: Commentaire romand, Code de procédure civile, 2a ed. 2018,
n. 8 ad art. 241 CPC);
dato che in tal caso la lite va stralciata dal ruolo (art. 241 cpv. 3 CPC);
106 cpv.
1 CPC);
ritenuto che nella commisurazione delle spese processuali si deve tenere conto del fatto che la decisione odierna si esaurisce in una dichiarazione di non entrata in materia (art. 21 LTG);
appurato che non si pone invece problema di ripetibili, il reclamo non essendo stato notificato alla controparte per osservazioni;
