Withdrawal of Appeal from Stay of Execution Proceedings
Sintesi Legislator
Generato dall'IAA party appealed a lower court's decision that rejected their request for a provisional stay of execution proceedings initiated by another party to collect a sum of money. However, the appealing party subsequently declared their withdrawal of the appeal, which the appellate court treated as a voluntary withdrawal (desistance), thereby terminating the proceedings with the effect of a final judgment. Consequently, the court struck the case from the roll, held the appellant liable for the court costs of the appeal, and ordered them to pay the opposing party a fixed amount for legal fees, noting that the jurisdictional threshold for further federal appeal was not met based on the value in dispute.

RE 1 contro
CO 1 (patrocinato dall’__________ PA 1, __________)
giudicando sul reclamo del 7 dicembre 2020 presentato dalla RE 1 contro la decisione emessa il 20 novembre 2020 dal Pretore, con cui ha respinto l’istanza 2 ottobre 2020 della RE 1 volta al rigetto provvisorio dell’opposizione all’esecuzione n. __________ dell’Ufficio d’esecuzione di Biasca promossa dalla reclamante per l’incasso di fr. 26'400.– oltre agli accessori, ponendo a suo carico le spese processuali di fr. 200.– e ripetibili a favore del convenuto di fr. 500.–;
preso atto dello scritto dell’8 febbraio 2021 con cui la RE 1 ha dichiarato di ritirare il reclamo;
cpv. 1 e 2 CPC, per il rinvio dell’art. 219 CPC; Tappy in: Commentaire romand, Code de procédure civile, 2a ed. 2018,
n. 8 ad art. 241 CPC);
dato che in tal caso la lite va stralciata dal ruolo (art. 241 cpv. 3 CPC);
106 cpv.
1 CPC);
ritenuto che nella commisurazione delle spese processuali si deve tenere conto del fatto che la decisione odierna si esaurisce in una dichiarazione di non entrata in materia (art. 21 LTG);
95 e 106 cpv. 1 CPC), determinate in virtù dell’art. 11 cpv. 1-2 RTar (RL 178.310) per il rinvio
dell’art. 96 CPC;
