Seizure Opposition Appeal Mootness and Equitable Cost Distribution
Sintesi Legislator
Generato dall'IAAn appellant challenged a lower court's decision that rejected their opposition to a seizure ordered to secure a claim of over 141,000 currency units. The appeal became moot because the party that initiated the seizure subsequently withdrew their request, leading the appellate court to strike the matter from the rolls. Given that the appeal was withdrawn due to the claimant's action and the parties showed goodwill, the court ruled that procedural costs should be distributed equitably, ultimately imposing minimal costs on the appellant while denying the opposing party's request for reimbursement of expenses since the appeal had not been formally served upon them for observations.

statuendo nella composizione a giudice unico (art. 48*b* LOG) nella causa SO.2018.2325 (opposizione al sequestro) della Pretura del Distretto di Lugano, sezione 5, promossa con istanza 4 maggio 2018 da
RE 1 IT- (patrocinato dall’__________ PA 1, __________) contro
CO 1 (patrocinata dall’__________ PA 2, __________)
giudicando sul reclamo del 28 settembre 2020 presentato da RE 1 contro la decisione emessa il 15 settembre 2020 dal Pretore, con cui ha respinto l’opposizione interposta al sequestro decretato il 29 marzo 2018 nei confronti del reclamante a domanda della CO 1 a garanzia di una pretesa di fr. 141'853.– oltre agli accessori, ponendo le spese processuali di fr. 500.– a carico dell’opponente, tenuta a rifondere fr. 2'500.– alla sequestrante a titolo di ripetibili;
preso atto dello scritto 25 marzo 2021 del reclamante, con cui comunica che la CO 1 ha ritirato l’istanza di sequestro e chiede di stralciare il reclamo dai ruoli in quanto divenuto senza oggetto, limitando al minimo le spese processuali visto il lungo impegno prodigato dalle parti per giungere a una soluzione transattiva;
accertato che, effettivamente, il reclamo è diventato senza oggetto con la rinuncia al sequestro, sicché la causa va stralciata dal ruolo (art. 242 CPC);
ricordato che in un caso del genere, di principio le spese processuali sono da ripartire secondo equità (art. 107 cpv. 1 lett. e CPC);
constatato che nella fattispecie il reclamante non contesta il principio per cui le spese processuali debbano essere poste a suo carico, ma chiede solo di limitarne l’importo “*al minimo”*;
tenuto conto del fatto che la decisione odierna si esaurisce in una dichiarazione di non entrata in materia (art. 21 LTG) e della buona volontà manifestata dalle parti;
ritenuto che non si pone invece problema di ripetibili, la controparte, cui il reclamo non è stato notificato per osservazioni, non essendo incorsa in spese in questa sede;
