The appellant filed a timely appeal against a lower court's decision rejecting their opposition to an enforcement action initiated by creditors concerning unpaid rent under a lease agreement where the appellant was jointly and severally liable as a tenant. The appellate court found the appellant's procedural argument regarding failure to be heard was moot because they did not request the decision be annulled on that basis, and the substantive ground for appeal—that enforcement was initiated only against them despite the lease being co-signed by their spouse—was correctly rejected because co-tenants are solidarily liable, and new factual arguments raised for the first time on appeal regarding Article 82(2) of the Enforcement and Bankruptcy Act were inadmissible. Consequently, the appeal was dismissed to the extent it was admissible, and no court costs were collected due to the peculiarity of the case and the appellant's lack of legal counsel.

Incarto n. 14.2013.106 · Lugano 20 giugno 2013 FP/ec/fb · In nome della Repubblica e Cantone Ticino Il presidente della Camera di esecuzione e fallimenti del Tribunale d’appello

sedente quale giudice unico (art.

1. CO 1 2. CO 2 3. CO 3 tutti rappresentati dall’a PA 1

esaminati gli atti,

ritenuto in fatto e considerato in diritto:

che contro le decisioni di rigetto dell’opposizione - come nella fattispecie - è dato il rimedio giuridico del reclamo (combinati art. 309 lett. b. n 3 e 319 lett. a CPC), da inoltrare entro 10 giorni dalla notificazione della sentenza impugnata (combinati art. 251 lett. a e 321 cpv. 2 CPC) alla Camera di esecuzione e fallimenti del Tribunale d’appello (art. 48 lett. e cpv. 1 LOG);

che inoltrato il 7 giugno 2013 contro una decisione emanata il 24 maggio 2013 e notificata/recapitata il 28 maggio successivo (cfr. ricerca Track&Trace), il reclamo è tempestivo e, quindi, da questo aspetto ammissibile;

che in base all’art. 320 CPC con il reclamo possono essere censurati sia l’applicazione errata del diritto che l’accertamento manifestamente errato dei fatti,

che nella misura in cui sostiene di non avere potuto esprimersi davanti al Pretore essendo arrivata in Pretura in ritardo, segnatamente alle ore 11.07 del 24 maggio 2013 - ancorché per motivi giustificati - anziché alle 11.00, ora fissata per l’udienza di contradditorio, che nel frattempo si era però conclusa, come comunicatole dalla cancelleria della stessa Pretura, la reclamante si avvale di un argomento che non le giova;

che al riguardo, infatti, essa non trae alcuna conclusione, ossia non chiede, per questo motivo, l’annullamento della decisione impugnata e, quindi, il conseguente rinvio degli atti al primo giudice per nuova decisione previa fissazione di una nuova udienza di contradditorio, per tacere comunque del fatto che essa non solo riconosce che l’udienza era già terminata quando è giunta in Pretura, ma non spiega perché tale inconveniente sarebbe da ricondurre a ragioni a lei non imputabili, di modo che non vi è motivo per soffermarsi oltre sulla questione;

che il reclamo è dipoi votato all’insuccesso nella misura in cui la reclamante si duole del fatto che la procedura esecutiva sia stata avviata solo nei suoi confronti, benché il contratto di locazione – ossia il titolo sul quale gli istanti hanno fondato la domanda di rigetto provvisorio dell’opposizione nei suoi confronti – fosse intestato anche a suo marito (oltre che a lei);

che, infatti, essendo il contratto in rassegna stato stipulato dagli istanti con più conduttori - in caso con __________ e __________ (ossia anche con la qui reclamante, che del resto non mette in dubbio il suo ruolo di conduttrice) - questi ultimi rispondono solidalmente nei confronti del locatore per tutti gli obblighi derivanti dal contratto stesso (cfr. doc. A, punto 25);

che a giusta ragione il Pretore – alle cui pertinenti motivazioni si rinvia - ha perciò considerato la documentazione esibita dagli istanti titolo di rigetto provvisorio dell’opposizione ex art. 82 cpv. 1 LEF nella misura in cui essi hanno proceduto per l’incasso delle pigioni riferite ai mesi da giugno a settembre 2012 rimaste impagate (doc. B);

che per quanto riguarda le obiezioni (di merito) esposte per la prima volta dall’insorgente nel reclamo e fondate sull’art. 82 cpv. 2 LEF, esse non possono essere esaminate da questa Camera, poiché nella procedura di reclamo non sono ammesse né nuove conclusioni, né l’allegazione di nuovi fatti o la produzione di nuovi mezzi di prova (art. 326 cpv. 1 CPC);

che ne discende perciò l’inammissibilità del rimedio al riguardo;

che, dato quanto precede, nella limitata misura in cui è ammissibile, il reclamo va pertanto disatteso;

che gli oneri processuali relativi al presente giudizio andrebbero posti a carico della reclamante quale parte soccombente (art. 48, 61 cpv. 1 OTLEF e 106 cpv. 1 CPC);

che, tuttavia, data la particolarità della fattispecie e tenuto conto che la reclamante non è assistita da un avvocato, si prescinde eccezionalmente dal riscuotere spese;

per questi motivi,

pronuncia:

1. Nella misura in cui è ammissibile, il reclamo è respinto.

2. Non si riscuotono spese.
