Bankruptcy Appeal Incorrectly Filed, Transferred to Civil Cassation Chamber
Sintesi Legislator
Generato dall'IAThe Appellate Court's Chamber of Execution and Bankruptcy determined that an appeal filed against a summary judgment in a bankruptcy matter was lodged with the wrong judicial body because the case value of CHF 2,606 was below the threshold for an appeal, requiring it to be treated as a recourse to the Civil Cassation Chamber instead. Consequently, the court, acting ex officio pursuant to procedural rules, ordered the transfer of the filing to the competent chamber and removed the case from its own docket, without assessing costs.
