Improper Appeal Submission in Execution Matter Leading to Transfer
Sintesi Legislator
Generato dall'IAThe Appellate Court's Chamber for Execution and Bankruptcy determined that an appeal filed against a lower court's summary ruling in an execution and bankruptcy matter, involving a claim value of CHF 3,168, was improperly submitted, as the law mandates that appeals for cases valued below CHF 8,000 must instead be treated as a recourse for cassation within the Civil Cassation Chamber. The court reasoned that when an instrument is presented to an incompetent judicial authority, that authority must *ex officio* transmit it to the competent authority and inform the filing party, therefore ordering the transfer of the appeal to the Civil Cassation Chamber without levying fees.
