Visto l’appello 31 luglio 2003 presentato da

la decisione 21 luglio 2003 del Segretario assessore della Pretora del Distretto di Lugano, sezione 5, che accoglie l'opposizione ex art. 278 LEF interposta da
__________ (rappr. dall'avv. __________
Preso atto della domanda contenuta nell’appello e volta all’ottenimento dell’effetto sospensivo;
richiamato l’art. 278 cpv. 4 LEF secondo cui l’opposizione e il ricorso non ostacolano l’efficacia del sequestro;
considerato che con il termine “opposizione” va intesa l’intera procedura di opposizione, compresa la decisione del giudice di primo grado, la quale non diventa esecutiva fino a quando il termine per ricorrere non è scaduto infruttuoso, rispettivamente fino a quando il ricorso interposto da una parte non è stato respinto dall’autorità superiore o ritirato;
atteso quindi che ope legis il sequestro rimane pienamente operante finché è sub iudice, la norma topica di diritto federale (art. 278 cpv. 4 LEF) derogando a quella cantonale (art. 22 cpv. 3 LALEF);
ritenuto che l’istanza per effetto sospensivo è di conseguenza irricevibile;
decreta 1. L’istanza per effetto sospensivo è irricevibile.
