An interested party sought to enforce an arbitration award concerning claims related to the use, enjoyment, administration, maintenance, and investment in specific real estate parcels, after an earlier challenge to the award by the other parties was rejected and became final. The court granted the enforcement request because the application met all statutory prerequisites under the Intercantonal Arbitration Concord (CIA), specifically that the award was formal, concerned a disposable claim, and that any prior recourse for nullity had been dismissed and finalized, resulting in the award being declared executory like an ordinary judgment, with procedural costs being borne by the requesting party since the opposing parties did not contest the execution.

Art. 250 CPC
Although not explicitly cited in the final operative part (dispositive), the reference to 'tassa di giustizia' (cost of justice) in order point 2, derived from the tariff, implies the application of procedural cost rules, which are often linked to the CPC or specific Cantonal legislation. However, strictly based on the provided dispositive, only the cost/procedure articles mentioned *there* should be included. Since the specific cost articles cited in the dispositive are related to the imposition of costs (Art. 148 CPC mentioned in the reasoning) and the tariffs, but the dispositive explicitly lists the financial burden, we must check for explicit citations within the orders. Order 2 establishes costs. The text mentions 'tariffa giudiziaria' but no specific article for costs other than the mention of Art. 148 CPC in the reasoning (not the dispositive). Given the strict instruction to only include articles cited *in the dispositive*, and seeing that the dispositive only enumerates the costs without citing a specific legal basis for imposing them *in the orders 1, 2, 3*, we rely on the mention of procedural rules applied in the reasoning for cost assignment (Art. 148 CPC) or the specific cost articles if they were present. Since no specific cost article is in the dispositive, and Art. 148 CPC is only in the reasoning leading to order 2, we will rely only on the substantive and procedural articles cited in orders 1 and 2.

segretaria: · Chietti Soldati, vicecancelliera

e __________ CONV1

in merito a pretese derivanti dall'uso, dal godimento, dall'amministrazione e dalla manutenzione delle particelle n. 1602 e 2364 RT (ora particella n. 1130 RT) di __________, come pure della particella n. 872 RFD di __________, oltre che dagli investimenti profusi in tali immobili;

esaminati gli atti,

posti i seguenti

punti di questione: 1. Se dev'essere accolta l'istanza;

2. Il giudizio sulle spese.

Ritenuto

fr. 29 035.35 quella di ISTA1 nei confronti del fratello CONV1 e in fr. 99 971.80 quella di CONV1 nei confronti della madre CONV1;

che con istanza del 4 agosto 2004 ISTA1 ha invitato questa Camera a certificare la forza esecutiva del lodo;

che il giudice delegato della Camera ha impartito ad CONV1 e CONV1, il 9 agosto 2004, un termine di dieci giorni per formulare eventuali osservazioni, avvertendoli che la decorrenza infruttuosa del termine sarebbe stata interpretata come rinuncia a contestazioni;

che nulla è pervenuto a tutt'oggi da parte loro;

e considerando

in diritto: che giusta l'art. 44 cpv. 1 CIA (RS 279 = RL 3.3.2.1.5) su richiesta di una parte l'autorità giudiziaria prevista dall'art. 3 lett. g CIA dichiara esecutivo, come una sentenza ordinaria, un lodo vertente su qualsiasi pretesa compromettibile (art. 5 CIA) qualora le parti abbiano accettato il lodo formalmente (lett. a), non sia stato interposto un tempestivo ricorso per nullità (lett. b), non sia stato attribuito effetto sospensivo a un ricorso per nullità introdotto in tempo utile (lett. c) oppure un eventuale ricorso per nullità sia divenuto privo di oggetto o sia stato respinto (lett. d);

3 cpv. 2 del decreto medesimo, con rinvio all'art.

360 CPC);

che in concreto la decisione prodotta è effettivamente un lodo arbitrale (non un semplice referto di arbitratore né una decisione provvisionale o interlocutoria), emesso a termini di equità, e che l'oggetto della contestazione rientrava senza dubbio nella libera disponibilità delle parti;

15 novembre 2001 (inc. 11.2000.134);

che quest'ultima sentenza non è stata impugnata sul piano federale ed è pertanto passata in giudicato;

che, ciò premesso, le condizioni disposte dall'art. 44 cpv. 1 CIA sono date e il lodo dev'essere dichiarato esecutivo alla stregua di una sentenza ordinaria, con relativa menzione in calce all'esemplare prodotto (art. 44 cpv. 2 CIA);

che gli oneri processuali vanno a carico dell'istante, CONV1 e CONV1 non essendosi opposti alla dichiarazione di esecutività e non potendo quindi essere considerati soccombenti (nell'accezione dell'art. 148 cpv. 1 CPC);

che per gli stessi motivi non si giustifica di attribuire ripetibili;

vista sulle spese anche la tariffa giudiziaria,

pronuncia: 1.

2. Gli oneri processuali, consistenti in:

*a)* tassa di giustizia fr. 200.–

*b)* spese fr. 50.–

fr. 250.–

sono posti a carico dell'istante.
