Eviction Appeal Dismissed for Untimely Filing
Sintesi Legislator
Generato dall'IAAn appellant challenged an eviction decree issued by a lower court, but the appellate court dismissed the appeal as inadmissible because it was filed late. The court reasoned that the appeal period for summary eviction proceedings is ten days, and since the contested decree was received on July 23rd, the deadline to file the appeal was August 2nd; as the appeal was postmarked on August 3rd, it was deemed tardy, and the statutory time limit is absolute and must be examined by the court *ex officio*.

AO1 (rappr. da RA1)
Richiamato l’art.
