Appeal Inadmissibility Due to Procedural Defects in Labor Dispute
Sintesi Legislator
Generato dall'IAThe appellant, against a lower court judgment awarding sums in a labor contract dispute, submitted a written appeal in German, which violated the rule requiring proceedings in Italian. Despite this language issue, the court found the appeal inadmissible because it failed to meet the substantive requirements of the relevant procedural code, specifically lacking stated claims and any factual or legal grounds, leading the appellate court to declare the appeal null and void without imposing costs, given the nature of the wage dispute.

Considerato
che lo scritto-ricorso di __________, presentato in lingua tedesca, non adempie ai requisiti dell’art. 117 CPC per il quale il processo deve svolgersi in lingua italiana;
che ciononostante si può eccezionalmente rinunciare al rinvio dell’atto per la traduzione (art. 117 cpv. 2 CPC ed art. 142 cpv. 3 CPC) poiché il contenuto dell’atto di ricorso non adempirebbe nemmeno i requisiti posti dall’art. 309 CPC (cfr. I CCA 5 giugno 1993 in re Autorità di vigilanza sulle tutele c. J.);
che infatti non contiene le domande (art. 309 cpv. 2 litt. e CPC) e, quel che più conta, non contiene alcun motivo di fatto e di diritto sul quale si fonda (art.
309 cpv. 2 litt. f CPC) con la conseguenza della sua nullità (art. 309 cpv. 5 CPC) e quindi inammissibilità (Cocchi/Trezzini, CPC, ad art. 309 n. 3;Rep. 1989, 140);
che tale situazione, per evidenti motivi di economicità di giudizio, va sanzionata già all’esame preliminare dell’art. 313bis CPC;
che trattandosi di procedura per mercedi e salari non si prelevano spese;
per i quali motivi
