An appellant sought review of a lower court's decision that entirely rejected their request for a rent reduction, with the appellate court treating the filed document as an appeal due to the case value exceeding the non-appealable threshold. The court declared the appeal void because it was submitted by an individual acting as a representative for their adult child without meeting the legal requirements for representation in civil proceedings, noting that the proper representation is a jurisdictional prerequisite that must be examined ex officio, leading to the nullity of the procedural act.

7 n. 1), supera quello limite della competenza inappellabile (art. 13 LOG);

che in ogni caso il gravame dev’essere respinto perché nullo;

che infatti esso è presentato dalla signora __________ - e da lei sola sottoscritto - in rappresentanza di __________ (in forza di procura 28 maggio 1996 agli atti dell’inc. dell’Ufficio di conciliazione) la quale non può fungere da patrocinatrice del figlio maggiorenne (nato nel 1967 come si evince dalla delega) non ricorrendo alcuna circostanza di cui agli art. 64 e seg. CPC, in particolare dell’art. 64bis cpv. 1 CPC per quanto riguarda le procedure di locazione;

che la legittimazione dei rappresentanti è un presupposto processuale da esaminare d’ufficio (art. 97 cifra 4 CPC) e che l’assenza di un presupposto processuale implica la nullità, rilevabile d’ufficio, dell’atto di procedura in questione (art. 142 cpv. 1 litt. a CPC e 142 cpv. 2 CPC);

Per i quali motivi

pronuncia

3. Intimazione a: - __________
