In an appeal concerning spousal maintenance and child support following a lower court's decision authorizing marital separation, awarding custody to the wife, and setting initial support payments, the appealing spouse sought significantly increased retroactive and ongoing support amounts for herself and the child. However, the appeal was withdrawn because the parties reached a comprehensive agreement regarding the effects of their divorce, leading the appellate court to strike the case from the docket due to voluntary desistance, ordering that each party bear the costs they incurred and equitably reducing the court fee, reflecting the parties' goodwill and the termination of proceedings without a final judgment.

AP 1 , (patrocinata dall'. PA 1),

giudicando sull'appello del 3 febbraio 2011 presentato dalla convenuta contro la decisione emessa dal Pretore il 21 gennaio 2011;

premesso che AO 1 (1956), vedovo, e AP 1 (1962) si sono sposati a __________ il 20 marzo 1997 e che dal matrimonio è nato E__________, il 10 dicembre 1997;

2010, di fr. 1685.– mensili dal 1° febbraio al 10 dicembre 2010 e di fr. 1570.– mensili in poi, oltre a uno per il figlio di fr. 615.– mensili dal 1° agosto 2009 al 31 gennaio 2010, di fr. 540.– mensili dal 1° febbraio al 10 dicembre 2010 e di fr. 660.– mensili in seguito (assegni familiari compresi), ponendo la tassa di giustizia di fr. 800.– e le spese a carico delle parti in ragione di metà ciascuno, compensate le ripetibili;

poi, così come quello per il figlio a fr. 1105.– mensili dal 1° agosto al 10 dicembre 2009 e a fr. 1445.– mensili in seguito (assegni familiari compresi);

ricordato che nelle sue osservazioni del 7 marzo 2011 AO 1 ha proposto di respingere l'appello;

ritirare l'appello;

constatato che, su richiesta del giudice delegato, l'appellante ha trasmesso alla Camera il 1° marzo 2012 copia della convenzione sugli effetti del divorzio, nella quale è pattuito – tra l'altro – il ritiro dell'appello in materia di protezione dell'unione coniugale;

rilevato che nelle circostanze descritte l'appello va tolto dai ruoli, mentre in ossequio all'accordo stipulato dalle parti le spese giudiziarie sono assunte da chi le ha anticipate, senza attribuzione di ripetibili;

ritenuto che non v'è ragione di scostarsi da quanto le parti hanno consensualmente e liberamente pattuito, fermo restando che la tassa di giustizia va ridotta in via equitativa, dovendosi tenere conto sia della buona volontà dimostrata dai contendenti sia del fatto che il processo termina senza un giudizio finale (art. 21 LTG);

decreta: 1.

3. Notificazione a:
