Appeal Dismissal for Failure to Deposit Judicial Costs
Sintesi Legislator
Generato dall'IAThe appellate court dismissed an appeal concerning the reduction of spousal support ordered by a lower court, as the appellant failed to deposit the required advance for judicial costs by the court-mandated deadline, despite receiving timely notification of the requirement and the warning that failure to pay would result in the appeal being struck from the record. The court reasoned that because the appeal was being struck due to the late payment of the necessary advance, it could not be examined on its merits, and the resulting procedural costs were assessed against the appellant who caused them, with a reduced fee due to the summary nature of the dismissal.

AP 1, (patrocinata dall'avv. PA 1);
premesso che con decreto cautelare del 22 agosto 2008 il Pretore del Distretto di Lugano, sezione 6, ha ridotto a fr. 167.– mensili il contributo alimentare per AP 1 stabilito con sentenza del 19 agosto 2005, riducendo conseguentemente una trattenuta di stipendio a carico di AO 1;
preso atto che contro il decreto cautelare AP
1 è insorta a questa Camera con un appello del 3 settembre 2008 nel quale chiede di fissare il contributo litigioso a fr. 959.65 mensili, adeguando la trattenuta di stipendio a tale importo;
rammentato che la richiesta di effetto sospensivo contenuta nell'appello è stata dichiarata irricevibile con decreto del 5 settembre 2008 dal presidente di questa Camera;
ricordato che con ordinanza dell'8 settembre 2008 l'appellante è stata invitata a depositare entro quindici giorni, a titolo di anticipo per le spese giudiziarie presunte, la somma di fr. 500.– sul conto corrente postale 69-10370-9 del Tribunale d'appello, introiti agiti, con l'avvertenza che, decorso infruttuoso il termine, l'appello sarebbe stato stralciato dai ruoli (art. 312 cpv. 2 CPC);
rilevato che l'ordinanza è pervenuta alla destinataria il 9 settembre 2008 (ricevuta postale agli atti), sicché il termine assegnatole è scaduto il 24 settembre 2008;
accertato che l'anticipo richiesto è stato versato solo il 3 ottobre 2008, senza che l'interessata abbia postulato – per ipotesi – una restituzione del termine (art. 137 CPC), del resto “non prorogabile” per espressa disposizione di legge (art.
312 cpv. 1 CPC);
ritenuto che nelle circostanze descritte l'appello sfugge a qualsiasi esame;
considerato che gli oneri processuali vanno a carico di chi li ha provocati, ma che la tassa di giustizia dev'essere adeguatamen-te ridotta, la procedura di appello terminando senza sentenza (art. 21 LTG per analogia);
stabilito che non si giustifica di attribuire ripetibili alla controparte, cui l'appello non è stato intimato e non ha cagionato costi presumibili;
richiamato l'art. 12 cpv. 1 LTG,
decreta: 1. L'appello è stralciato dai ruoli per tardivo versamento dell'anti-cipo.
2. Gli oneri processuali, consistenti in:
*a)* tassa di giustizia fr. 50.–
*b)* spese fr. 50.–
fr. 100.–
sono posti a carico dell'appellante. Non si assegnano ripetibili.
3. Intimazione:
–; –o. Comunicazione alla Pretura del Distretto di Lugano, sezione 6.
