Father Withdraws Custody Appeal, Deemed Losing Party for Costs
Sintesi Legislator
Generato dall'IAThe case originated from a matrimonial protection proceeding where the first instance court awarded custody of the children to the mother and set spousal support payments owed by the father. The father appealed, seeking a reduction in the monthly support contributions for each child, but subsequently withdrew the appeal after being informed that under the unlimited investigative principle, the support amount could potentially be increased (*reformatio in peius*). The appellate court ruled that withdrawal constitutes a voluntary surrender of the appeal, leading to its dismissal from the roll, and consequently, the withdrawing party (the appellant) is deemed the losing party responsible for court costs, expenses, and reimbursement of the opposing party's legal fees.

sedente per statuire nella causa DI.2002.200 (protezione dell'unione coniugale) della Pretura della giurisdizione di Locarno Città promossa con istanza del 16 ottobre 2002 da
AO 1 (patrocinata dall' RA 2 ) contro
AP 1 (patrocinato dall' RA 1 );
Ritenuto
(1989) alla madre, ha regolato il diritto di visita del padre e ha posto a carico di quest¿ultimo un contributo alimentare di fr. 1115.¿ mensili per C__________ (dal 15 ottobre 2001 al 30 settembre 2002 e dal 15 febbraio 2003 in poi), uno di fr. 1115.¿ mensili per T__________ (dal 15 ottobre 2001 in poi) e uno di fr. 1115.¿ mensili per A__________ (dal 15 ottobre 2001 in poi), assegni familiari compresi;
che contro la citata sentenza AP 1 è insorto con un appello dell'8 maggio 2003 in cui ha chiesto di ridurre il contributo alimentare per i figli a fr. 900.¿ mensili ciascuno dal 16 ottobre 2002 (assegni familiari compresi);
che nelle sue osservazioni del 20 giugno 2003 AO 1 ha proposto di respingere l'appello;
che con lettera del 9 marzo 2006 il giudice delegato della Camera ha reso attento l'appellante come, nelle circostanze concrete, la sentenza si sarebbe potuta risolvere in una *reformatio in peius*, nel senso che in virtù del principio inquisitorio illimitato il contributo per i figli si sarebbe anche potuto rivelare più alto di quello fissato dal Pretore;
che il 30 marzo 2006 l'interessato ha dichiarato di ritirare l'appello;
e considerando
in diritto: che il ritiro dell'appello configura un atto di desistenza;
che, dandosi desistenza, l¿appello va stralciato dai ruoli (art. 352 cpv. 1 e 2 CPC);
che nelle circostanze descritte rimane da statuire sugli oneri processuali e le ripetibili di secondo grado;
che, sotto questo profilo, chi recede dalla lite è reputato soccombente (Rep. 1978 pag. 375);
che il soccombente è chiamato ad assumere la tassa di giustizia e le spese, come pure a rifondere alla controparte un'adeguata indennità per le spese di patrocinio (art. 148 cpv. 1 CPC);
che nella fattispecie non si ravvisano ¿giusti motivi¿ (a norma dell'art. 148 cpv. 2 CPC) né ragioni di equità (a norma dell'art. 77 cpv. 3 CPC) per scostarsi da tale principio:
che, quanto alla tassa di giustizia in particolare, essa va adeguatamente ridotta poiché la causa non termina con un giudizio di merito (art. 21 LTG), senza dimenticare però che l'avvertimento previo all'appellante ha reso necessario un approfondito esame dell'intero carteggio;
vista sulle spese anche la tariffa giudiziaria,
decreta: 1.
