Denial of Suspensive Effect for Appeal of Marital Protection Order with Alimony Provisions
Sintesi Legislator
Generato dall'IAA party appealing a first-instance decision concerning measures for the protection of the marital union sought a suspensive effect for their appeal, but the appellate court denied the request, reasoning that decisions regarding marital protection measures, similar to provisional measures in separation or divorce cases, are provisionally enforceable unless otherwise ordered, and furthermore, given the matter involved alimony payments, it was deemed more appropriate to maintain the existing judicial decision, even while under appeal, rather than rely on the unilateral offer of the appealing party pending the appeal outcome.

__________ (patrocinata __________);
ricordato che le sentenze emanate in camera di consiglio – tra cui le misure a tutela dell'unione coniugale (art. 4 cpv. 1 n. 5 e art. 5 LAC) – sono provvisoriamente esecutive, salvo che il presidente della Camera adita non disponga altrimenti (art. 310 cpv. 4 lett. b CPC);
ritenuto che non v'è motivo per trattare le misure a protezione dell'unione coniugale diversamente dalle misure provvisionali nelle cause di separazione o divorzio (art. 137 CC), cui in sede di appello l'effetto sospensivo è negato per legge (art. 310 cpv. 4 lett. a CPC);
stabilito inoltre che, trattandosi nella fattispecie di contributi alimentari, appare di gran lunga più adeguato mantenere in vigore una decisione giudiziaria, ancorché impugnata, piuttosto che far dipendere l'ammontare dei contributi in pendenza di ricorso da un'offerta unilaterale del convenuto, come vorrebbe quest'ultimo (appello, pag. 11 a metà);
richiamato l'art. 370 cpv. 3 CPC,
decreta: 1. La richiesta di effetto sospensivo è respinta.
