Divorce Modification Appeal Costs Reapportionment and Legal Aid Grant
Sintesi Legislator
Generato dall'IAFollowing a federal court decision that effectively reinstated the lower court's ruling in a divorce modification case, the appellate court was tasked with reapportioning the costs and fees for the appeal. The court found that the appellant was entirely unsuccessful in the appeal and thus liable for the appeal costs and ordered them to reimburse the opposing party for CHF 2000 in costs; however, due to the appellant's severe financial hardship and the arguable merit of their appeal, the court granted the appellant legal aid for the appeal, while confirming the cost allocation from the first instance proceedings.

sedente per statuire nella causa __________.__________.__________ (modifica di sentenza di divorzio) della Pretura del Distretto di Riviera promossa con petizione del 26 aprile 1996 da
__________ __________, __________ (patrocinato dall'avv. __________ __________, __________) contro
__________ __________, __________ (patrocinata dall'avv. __________ __________, __________);
preso atto che con sentenza del 9 maggio 2001 il Tribunale federale ha riformato il giudizio emesso il 6 novembre 2000 da questa Camera (inc. __________.__________.__________), rinviando gli atti per nuova decisione sulle spese e le ripetibili di primo e secondo grado;
accertato che la sentenza del Tribunale federale ripristina – in pratica – il sindacato del Pretore, ciò che giustifica di ripristinare anche il dispositivo sulle spese e le ripetibili emanato in quella sede (non impugnato dall'attore);
ritenuto che, seguendo il giudizio del Tribunale federale, in appello la convenuta sarebbe risultata del tutto soccombente e si sarebbe trovata quindi a sopportare gli oneri processuali del ricorso (art. 148 cpv. 1 CPC);
considerato che, nonostante la soccombenza, la convenuta può essere posta al beneficio dell'assistenza giudiziaria in appello (art. 155 CPC), date le gravi ristrettezze in cui versa e la circostanza che il suo gravame sembrava provvisto di buon diritto;
pronuncia: 1. Gli oneri processuali di appello, consistenti in:
*a)* tassa di giustizia fr. 1000.–
*b)* spese fr. 50.–
fr. 1050.–
4. Intimazione:
– avv. __________ __________, __________
– avv. __________ __________, __________.
