Sintesi Legislator
Generato dall'IAThe appeal, lodged against a provisional order regulating spousal arrangements, was withdrawn by the appellant; the court acknowledged the withdrawal, equating it to a desistment which generally requires the withdrawing party to bear resulting costs, but ordered a reduced judicial fee given the case ended without a full judgment, and explicitly denied costs to the opposing party as the procedure had not caused them any expenses.

sedente per statuire nella causa __.__._____ (misure provvisionali in causa di stato) della Pretura del Distretto di Lugano, sezione 6, promossa con istanza del 30 novembre 1998 da
__________ __________, nata __________, __________ (ora patrocinata dall'avv. __________ __________. __________, __________)
contro
__________ __________, __________ (patrocinato dall'avv. __________ __________, __________);
premesso che con decreto cautelare dell'8 aprile 1999 il Pretore del Distretto di Lugano, sezione 6, ha regolato l'assetto provvisionale tra i coniugi __________ e __________ __________;
accertato che contro tale decisione ha ricorso l'istante con appello del 22 aprile 1999;
constatato che il convenuto non ha presentato osservazioni;
preso atto che il 7 gennaio 2002 __________ __________ ha dichiarato di ritirare l'appello;
stabilito che nelle circostanze descritte rimane da decidere sugli oneri processuali e le ripetibili di seconda sede;
rammentato che, di regola, il ritiro di un appello equivale a desistenza, sicché il recesso da una lite comporta l'obbligo di sopportare le tasse e le spese cagionate (Rep. 1990 pag. 284, 1978 pag. 375 seg.);
considerato che nella fattispecie non vi è motivo per scostarsi da tale principio, ma che la tassa di giustizia va adeguatamente ridotta per tenere conto che il processo termina senza sentenza (art. 21 LTG);
ritenuto in ogni modo che non si giustifica di attribuire ripetibili alla controparte, cui la procedura non ha comportato spese;
richiamato l'art. 352 cpv. 1 e 2 CPC,
decreta: 1. Si prende atto del ritiro dell'appello. La causa è stralciata dai ruoli per desistenza.
2. Gli oneri processuali, consistenti in:
*a)* tassa di giustizia unica fr. 100.–
*b)* spese fr. 50.–
fr. 150.–
sono posti a carico dell'appellante. Non si assegnano ripetibili.
