sedente per statuire nella causa n__________.__________.__________ (misure cautelari in causa di stato) della Pretura del distretto di Leventina promossa con istanza 30 maggio 1995 da
__________ __________ nata __________, __________ (patrocinata dall’avv. __________ __________, __________) contro
__________ __________, __________ (patrocinato dall’avv. __________ __________, __________);
premesso che __________ __________ ha interposto appello il 29 febbraio 1996 contro un decreto cautelare del 23 febbraio 1996 con cui il Pretore del Distretto di Leventina ha disciplinato l’assetto provvisionale dei coniugi durante la causa di stato;
preso atto che il 25 aprile 1996 l’appellante ha dichiarato di ritirare il gravame, le parti avendo concluso all’udienza del 24 aprile 1996 una convenzione sugli effetti accessori del divorzio;
ricordato che il ritiro dell’appello equivale a desistenza (Rep. 1978 pag. 375), la quale pone fine alla lite (art. 353 cpv. 1 CPC) e comporta, in linea di principio, l’addebito degli oneri processuali con obbligo di rifondere alla controparte una congrua indennità per ripetibili;
ritenuto che appare giusto tenere conto della buona volontà dimostrata dalle parti nel risolvere il loro contenzioso e rinunciare pertanto in questa sede al prelievo di tasse e spese (art. 148 cpv. 2 CPC);
constatato che l’appellata ha comunicato di rinunciare all’assegnazione di ripetibili;
richiamato l’art. 352 cpv. 1 CPC,
decreta:
1. L’appello è stralciato dai ruoli per desistenza.
2. Non si riscuotono spese né si assegnano ripetibili.
