Divorce Appeal Withdrawal and Cost Allocation
Sintesi Legislator
Generato dall'IAIn a divorce action, the appellant withdrew the appeal against a precautionary decree after the parties reached an agreement, leading the court to strike the case from the rolls due to desistment. The court reasoned that while the withdrawal constituted desistment, the court fee should be equitably reduced to account for the parties' goodwill, and the parties' agreement to have each bear their own incurred costs and compensate for legal fees was respected, resulting in the appellant bearing the reduced court costs while legal fees were offset.
