Acquittal for Property Damage After Demolition
Sintesi Legislator
Generato dall'IAThe accused was charged with property damage for authorizing the dismantling and destruction of a shack located on a property he had purchased, causing damage to the civil claimant. Following the accused's opposition to the initial indictment, the court examined the evidence presented by the parties, including the accusation, the defense arguing a lack of objective and subjective elements for the offense, and the civil claimant's request to uphold the initial finding. Ultimately, the court acquitted the accused of the charge of damage, finding that the elements of the crime were not met, and consequently assigned the procedural costs to the state, while referring the civil claims to the competent civil forum.
