Public Transport Law Infraction and Withdrawal of Criminal Prosecution
Sintesi Legislator
Generato dall'IAAn individual was charged with an infraction of the public transport law stemming from events on January 14, 2004, in Lugano, for which a fine, civil compensation, and procedural costs were proposed. Following the timely opposition to this charge, the court noted that the accused had subsequently paid the required CHF 100 compensation to the civil party as requested, although this payment had been negligently omitted from communication to the public prosecutor; consequently, the court ruled that the public ministry withdrew from criminal prosecution, annulling the initial accusation decree and determining that no criminal proceedings or fees would be levied against the accused.
