An accused individual, initially convicted for simple assault, theft of use, and driving without a license stemming from incidents in August and September 2002, filed an opposition to the proposed sentence but also requested a reinstatement of the deadline to file the appeal. The court found the request for reinstatement inadmissible and consequently dismissed the opposition as untimely because the notification of the indictment, sent by registered mail, was deemed legally complete on January 22, 2003, after seven days of non-collection, and the appeal was filed on April 3, 2003, well beyond the ten-day limit from the cessation of any alleged impediment (the date the accused admitted to learning of the indictment via a subsequent summons). The court reasoned that the failure to collect the mail was attributable to the accused, who neither explained nor proved any non-culpable reason for the delay, and furthermore, the subsequent request for reinstatement itself was filed outside the statutory ten-day period following the cessation of the impediment.

__________, nato a __________ /__________, cittadino jugoslavo, domiciliato a __________, Via __________, celibe, pittore

siccome

ritenuto colpevole di lesioni semplici, furto d'uso, circolazione senza licenza di condurre;

fatti avvenuti il 23 agosto 2002 e il 1 settembre 2002 a __________;

reato previsto dall' art. 123 cifra 1 CP, art. 94 cifra 1 cpv. 1 LCS, art. 95 cifra 1 LCS;

e meglio come al decreto d’accusa no. DA ______________________________ di data __________ 2003 del Procuratore pubblico Antonio Perugini, __________, per cui fu proposta la condanna

vista l'opposizione interposta in data 3 aprile 2003 dall'accusato;

rilevato che con lo scritto d'opposizione l'accusato chiede pure la restituzione del termine per interporre l'opposizione stessa;

considerato in fatto e in diritto

che il decreto di accusa del 13 gennaio 2003 è stato intimato per raccomandata il giorno stesso al domicilio dell'accusato a __________;

che l'invio è rimasto in giacenza presso l'ufficio postale di __________ dal 15 al

22 gennaio 2003 ed è ritornato al mittente il 28 gennaio 2003 con la menzione "non ritirato" (cfr. atto 9);

che la notificazione di atti giudiziari per raccomandata si reputa avvenuta, in caso di mancato ritiro da parte del destinatario, il settimo e ultimo giorno di giacenza presso l'ufficio postale (cfr. DTF 127 I 34);

che nella fattispecie la notificazione del decreto di accusa all'interessato è quindi validamente avvenuta il 22 gennaio 2003;

che di conseguenza l'opposizione è tardiva;

che l'accusato chiede la restituzione del termine per interporre opposizione, poiché sostiene di non avere mai ricevuto il decreto di accusa e di averne avuto conoscenza solo al ricevimento della citazione 21 febbraio 2003 della Pretura di __________;

che per l'art. 21 CPP la restituzione per inosservanza di un termine può essere concessa unicamente se la parte o il suo patrocinatore prova di non averlo potuto osservare perché impedita senza sua colpa;

che in concreto il mancato ritiro della raccomandata è imputabile all'accusato, il quale non spiega, tantomeno prova, i motivi per quali sarebbe stato impedito di farlo;

che quand'anche si volesse prescindere dalla colpa per il mancato ritiro l'istanza non potrebbe essere comunque accolta, perché tardiva;

che per l'art. 22 cpv. 1 CPP l'istanza deve infatti essere presentata, pena la decadenza, entro dieci giorni dalla cessazione dell'impedimento;

che il signor __________ stesso ammette di aver avuto conoscenza del decreto quando ha ricevuto la citazioni intimatagli il 21 febbraio 2003 dalla Pretura di __________: nell'ipotesi a lui più favorevole questa citazione gli è stata notificata il 29 gennaio 2003, ciò significa che la restituzione del termine doveva essere chiesta entro il 8 febbraio 2003;

che l'istanza 3 aprile 2003 è quindi tardiva e pertanto irricevibile;

visti gli art. 21, 22, 208 e 210 CPP

pronuncia: 1. L'istanza di restituzione dei termini è irricevibile.

2. L'opposizione è irricevibile.

3. L'incarto è ritornato al Ministero pubblico per quanto di sua competenza.

4. La tassa di giustizia di fr. 100.- e le spese di fr. 50.- relative a questa decisone sono a carico di __________ __________.

5. Intimazione a:

__________ __________, Via __________ __________, __________, Procuratore pubblico Antonio Perugini, Viale __________, __________, __________ __________, Via __________, __________, Avv. __________ __________, Via __________, __________,
