Appeal Regarding Jurisdiction Over Criminal Cost Waiver Denial
Legislator-Zusammenfassung
KI-generiertAn individual, convicted of a traffic offense and facing fines and costs totaling over CHF 2,500, appealed the Department of Finance's denial of their application for a cost waiver. The court ruled that the Department of Finance was not the statutorily authorized authority to decide on the waiver of criminal prosecution costs, as jurisdiction lies with the authority that set the costs; consequently, the Department's decision was void for violating material jurisdiction, leading the court to uphold the appeal, declare the previous decision void, and remit the matter to the competent authority for a new decision, with the canton bearing the court costs.
Legislator-Regeste
KI-generiert§ 49 Gerichtsorganisationsgesetz, GO, BGS 125.12, §§ 5 und 6 des Verwaltungsrechtspflegegesetzes (VRG, BGS 124.11, Art. 66 al. 1 LTF; Appeal Regarding Jurisdiction Over Criminal Cost Waiver Denial: The court ruled that the Department of Finance was not the statutorily authorized authority to decide on the waiver of criminal prosecution costs, as jurisdiction lies with the authority that set the costs; consequently, the Department's decision was void for violating material jurisdiction, leading the court to uphold the appeal, declare the previous decision void, and remit the matter to the competent authority for a new decision, with the canton bearing the court costs.

KI-generiertThis provision confirmed the court's jurisdiction to rule on the appeal against the decision of the Finance Department.
These procedural rules were cited as the legal basis that the Finance Department violated regarding its substantive jurisdiction, leading to the nullity of its decision (though the violation itself, not the application, is the core of the finding, the court cited them in the reasoning leading to the nullity order in order 1).
This provision is implicitly referred to by ordering the Canton Solothurn to bear the costs of the administrative court proceedings in order 2.

In Sachen

Beschwerdegegner
betreffend Kostenerlass
zieht das Verwaltungsgericht in Erwägung:
I.
2. Mai 2019 in Rechnung.
§ 49 Gerichtsorganisationsgesetz, GO, BGS 125.12).
3. Die Akten werden der Staatsanwaltschaft Solothurn überwiesen.
