Appeal Dismissed for Inadmissible New Arguments in Opposition Lifting Challenge
Synthèse Legislator
Généré par l'IAThe court dismissed an appeal challenging the definitive lifting of an opposition filed against a judgment, reasoning that the appellant failed to articulate any permissible ground for cassation, such as arbitrary factual findings or a misapplication of law by the lower court. Specifically, the court found the appellant's reliance on the statute of limitations to be an inadmissible new argument because it was not raised before the first judge, as required when the objection was already accrued, leading to the immediate rejection of the entirely inadmissible appeal.

Texte complet
