Narcotics Jurisdiction Threshold Adjustment Based on Purity Levels

The Public Prosecutor's Conference issued an instruction adjusting the threshold for cases concerning severe narcotics offenses under Art. 19 Ziff. 2 lit. a of the Narcotics Act, which determine the jurisdiction of the Criminal Court. Based on federal case law defining a "severe case" by pure substance weight (12g Heroin, 18g Cocaine) and subsequent industry trends showing decreasing purity for smaller quantities, the court revised the assumed average purity levels from 25% (Heroin) and 33 1/3% (Cocaine) to a new standard of 15% for Heroin and 33 1/3% for Cocaine, thereby raising the minimum mixture weight required for Criminal Court jurisdiction to at least 80g of Heroin mixture or 54g of Cocaine mixture.
