Lack of Capacity to Litigate Bars Motion for Judicial Disqualification
Legislator-Zusammenfassung
KI-generiertA litigant, who had previously filed an administrative appeal against a departmental decision, subsequently submitted a motion for the disqualification of the presiding judge, while also indicating that they had requested the removal of their legal curator and that this matter was pending. The court determined that since the litigant remained under legal curatorship, as confirmed by correspondence showing the curator was responding to the request for removal, and had failed to provide the required authorization from the curator or the relevant protection authority to proceed with the appeal as previously ordered, the litigant lacked the capacity to litigate. Consequently, the court dismissed the motion for disqualification as inadmissible because a fundamental procedural requirement—the capacity to act—was absent, precluding any consideration of the merits of the recusal request, and waived the imposition of court costs due to the particular circumstances.

KI-generiertThis provision was cited as the basis for the sole judge to issue the decision because the motion for recusal was manifestly inadmissible.
Although the decision is from a cantonal administrative court, the structure suggests that the rule for costs (Art. 66 al. 1 LTF in Swiss Federal Practice) is often used analogously or that the text contains a transcription error for a local cost rule. However, based strictly on the explicit content of the dispositive, no specific cost provision cited in the reasoning (which mentions waiving costs) appears in the orders 1 or 2 other than the implicit procedural basis. Since the rules state to include cost provisions cited in the dispositive, and order 2 states 'Non si prelevano spese processuali' without citing a specific article, no cost provision is strictly extractable based on the provided text and rules.

VERWALTUNGSGERICHT DES KANTONS GRAUBÜNDEN DRETGIRA ADMINISTRATIVA DAL CHANTUN GRISCHUN TRIBUNALE AMMINISTRATIVO DEL CANTONE DEI GRIGIONI
U 22 93
1a Camera
Giudice unico Audétat Attuario Paganini
SENTENZA del 10 novembre 2022
nella vertenza di diritto amministrativo
A._____, ricorrente
contro
I. Considerato:
II. Il Giudice unico decide:
1. L'istanza di ricusazione è irricevibile.
2. Non si prelevano spese processuali.
