Legislator-Zusammenfassung

KI-generiert

An individual sought the revision of a penal order dated January 24, 2025, which convicted them of repeated failure to return licenses and registration plates, imposing a suspended fine and a monetary penalty. The applicant argued that the order's failure to mention that the conviction would be recorded in the criminal register constituted a fundamental right violation and a formal error justifying revision under the applicable procedural code. The court dismissed the application as manifestly inadmissible, reasoning that the alleged omission regarding the entry in the criminal register does not fall within the exhaustive enumerated grounds for revision provided by the relevant statute, which requires new facts or evidence leading to acquittal or a significantly different sentence, or subsequent contradictory judicial decisions.

Decreto del 25 giugno 2025 comunicato il 25 giugno 2025

N. d'incarto SR1 25 24

Istanza Prima Camera penale

Composizione Moses, presidente

Parti A._____ istante

Oggetto Revisione

VV.2024.4007) Ritenuto in fatto e considerando in diritto:

3. A norma dell'art. 410 cpv.

388 cpv. 2 lett. a CPP).
