Appeal Regarding Immediacy and Procedural Deadlines in Evidence Submission
Legislator-Zusammenfassung
KI-generiertThe appellant challenged a verdict, asserting violations of the principles of immediacy (Art. 106 LGP) because witnesses were not heard during the trial, and of procedure (Art. 105 LGP) because no deadline was set for submitting evidence requests. The court reasoned that the criminal procedure does not strictly follow the principle of immediacy, as evidence is primarily derived from the file, with direct presentation being the exception, particularly when the facts are already well-clarified by the investigating judge or president; thus, the non-hearing of witnesses who had already testified was not a violation, especially since the appellant was seen as abusing rights by delaying the process. Furthermore, the court held that setting a deadline for evidence requests is merely a prescriptive order, as requests can be made until the close of the main hearing, and since the appellant was ultimately able to propose evidence, no disadvantage resulted from the omitted deadline.

Considerandi:
a) In primo luogo l'appellante censura una violazione dell'art.
106 cpv.
