Insured Person v. Cantonal Disability Insurance Office (Mootness due to Timely Reconsideration)
Synthèse Legislator
Généré par l'IAThe case involved an appeal by an insured person against a Cantonal Disability Insurance Office decision that granted only a quarter disability pension for a specific period; however, the Office subsequently issued a new decision on the same day it provided notice to the court, effectively withdrawing the initial decision and ordering further investigation and a new ruling. The Canton Court of Social Insurance held that, pursuant to the Federal Act on the General Part of Social Insurance Law, the insurer retained the right to reconsider a decision being appealed until the appeal notice was sent to the appellate authority, concluding that the original appeal was therefore rendered moot given the insurer's timely reconsideration, and consequently dismissed the appeal while ordering the Office to pay the appellant's legal costs.
