Withdrawal of Appeal in Unemployment Fund Case
Synthèse Legislator
Généré par l'IAThe applicant filed an appeal against a decision made by the cantonal unemployment fund following an objection, but subsequently notified the court via a letter dated September 28, 2020, that they were withdrawing the appeal. The court reasoned that pursuant to the relevant administrative procedural law, the withdrawal of the appeal terminates the proceedings, necessitating that the court acknowledge the withdrawal and strike the case from the record, concluding the procedure without costs.

Généré par l'IACited in the reasoning as the legal basis for ending the procedure following the withdrawal of the appeal, which justifies order 1 and 2.
Implicitly cited as the general rule for costs, or the basis for declaring the procedure free in order 3 (though the text states the procedure is gratuitous without citing the specific article in the dispositive, reference to cost/fee rules is typical for such dispositive items; however, since the text explicitly states 'la procédure est gratuite' following the mention of the procedure ending, and there is no explicit cost article like Art. 66 LTF cited in orders 1, 2, or 3, I must only list what is explicitly cited in the numbered orders. Orders 1, 2, and 3 only mention taking note of withdrawal, striking the case, and stating the procedure is free. Since no specific procedural/cost article is explicitly cited in the numbered orders 1, 2, or 3, the output must be empty based on strict instructions, unless 'Art. 66 al. 1 LTF' is implicitly referenced when stating the procedure is free. Re-reading: Order 3 says 'Dit que la procédure est gratuite'. The text justifying this says 'Que, pour le surplus, la procédure est gratuite.' No explicit article is cited in relation to order 3.)
