Moot Appeal Due to Annulment of Initial Decision
Synthèse Legislator
Généré par l'IAAn insured person appealed a decision from the cantonal disability insurance office (OCAI) that had rejected their claim for a disability pension. However, before the court could rule on the appeal, the OCAI issued a new decision annulling its initial ruling and remitting the case for further investigation and a new decision. The court found that, pursuant to the Federal Act on the General Part of Social Insurance Law, an insurance provider can reconsider its decision up until the transmission of its opinion to the court, which occurred here, thus rendering the initial appeal moot and requiring the case to be removed from the court's docket, while ordering the OCAI to compensate the appellant for legal costs.
