Cantonal Disability Insurance Office v. Appellant (Cost Indemnity)
Synthèse Legislator
Généré par l'IAAfter a case involving repeated decisions by the Cantonal Office of Disability Insurance and subsequent appeals, including an initial ruling by the Cantonal Court of Social Insurance that was overturned by the Federal Insurance Tribunal due to irregular composition, the Tribunal fédéral des assurances ultimately annulled the Cantonal Court's latest decision and instructed the court to rule on costs. The Cantonal Court, acknowledging that the appellant ultimately prevailed, reasoned that the appellant was entitled to an indemnity for costs and attorney fees, calculating the amount based on the case's procedural history to set the final award for costs at 1,750 Swiss francs to be paid by the Cantonal Office of Disability Insurance to the appellant.

Although not explicitly cited in the final French text provided, the imposition of costs (condamne l'office à verser des dépens) typically relies on the cantonal equivalent of procedural rules governing costs, which is often referenced in the context of federal procedure (LTF/BGG) when deciding on expenses.
