Synthèse Legislator

Généré par l'IA

An employer, having received Return to Employment Allowance (ARE) benefits for an employee who resigned due to non-payment of salary, had those benefits revoked and repayment of CHF 82'880.25 demanded by the cantonal employment office. The employer appealed, not contesting the right to restitution but requesting a waiver based on the employer's good faith and the precarious financial situation that repayment would cause the company. The court acknowledged the employer's withdrawal of the appeal contesting the restitution itself but decided that the request for a waiver of the repayment obligation falls within the competence of the opposing administrative office, thus transmitting that specific request to that authority.

POUVOIR JUDICIAIRE

A/3894/2019 ATAS/732/2020 COUR DE JUSTICE Chambre des assurances sociales

Arrêt du 3 septembre 2020 3ème Chambre

En la cause

A______, sise à GENEVE · recourante

contre

OFFICE CANTONAL DE L'EMPLOI, Service juridique, rue des Gares 16, GENÈVE · intimé

Attendu en fait que la société A______ (ci-après : l'employeur) a déposé une demande d'allocation de retour en emploi (ci-après : ARE) en faveur de Monsieur B______(ci-après : l'employé) ;

Que par décision du 4 octobre 2017, l'office cantonal de l'emploi (ci-après : OCE) a admis la demande et octroyé une ARE du 18 septembre 2017 au 17 juin 2019 ;

Qu'ayant appris que l'employé avait démissionné de son poste le 27 juin 2018 en raison du non-paiement de son salaire depuis janvier 2018, l'OCE, par décision du 14 juin 2019, a révoqué sa décision du 4 octobre 2017 et réclamé le remboursement de CHF 82'880.25, soit la somme totale des montants versés à l'employeur au titre de l'ARE ;

Que cette décision a été confirmée sur opposition le 12 septembre 2019 ;

Que l'employeur a interjeté recours auprès de la Cour de céans en demandant en substance à ce que l'autorité renonce à exiger la restitution au vu de la bonne foi de l'employeur, car la restitution placerait l'entreprise dans une situation extrêmement précaire ;

Qu'invité à se déterminer, l'intimé, dans sa réponse du 14 novembre 2019, a conclu au rejet du recours ;

Qu'une audience de comparution personnelle s'est tenue en date du 3 septembre 2020, à l'issue de la laquelle l'employeur, indiquant qu'il ne contestait pas le bien-fondé de la restitution en elle-même, a retiré son recours, tout en maintenant sa demande de remise de l'obligation de restituer ;

3. Dit que la procédure est gratuite.
